Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.visitpavilion.com website (the “Service”) operated by VisitPavilion Ltd (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Who We Are.
Pavilion is a ticketing and registration platform with the goal to help people to transcendence everyday life by visiting engaging artistic and lifestyle experiences. With our platform, we will help artists and art lovers to show their art to a large number of consumers and organize and host exciting experiences for visitors. Pavilion is opening up the possibility to everybody to escape daily routine and experience unusual life.
Pavilion’s websites and domains, including www.visitpavilion.com, and all of the webpages, subdomains, country level domain variants and subparts of those websites (collectively, our “Site”), all of the services available on or through the Site or otherwise provided by us (including our application programming interfaces) are offered, maintained and provided by Pavilion. We refer to all of these as our “Services.”
Through the Services, Pavilion provides a simple and quick means for registered users who are experience organizers and hosts (“Organizers”) to create experiences registration, organizer profile, and to promote those pages to visitors or browsers on the Services and to sell tickets. Also organizers can sell merchandise related to those experiences to users who wish to make purchases (“Visitors”). We refer to Organizers, Visitors and other visitors and browsers of the Services collectively as “Users” or “you.”

Creating an account, listing an experience and accessing the Services is free. We charge our fees only when you buy tickets. All descriptions of standard fees on the Services represent the standard fees that Pavilion charges to Visitors. Pavilion does not control (and thus cannot disclose) fees levied by your bank and/or credit card company, including fees for purchasing tickets in foreign currencies or from foreign persons. Be sure to check with your bank or credit card company prior to engaging in a transaction to understand all applicable fees, credit card surcharges and currency conversion rates.
Pavilion is not the organizer or owner of the experiences listed for sale on the Services. Pavilion provides the Services, which allow Organizers to list, promote and sell tickets for their experiences. Pavilion acts as the Organizer’s limited agent solely for the purpose of using its third party payment providers to collect payments made by Attendees on the Services with respect to an experience and passing such payments through to the applicable Organizer. It is the Organizer’s sole obligation to ensure that any experience page posting on the Services and the nature and conduct of the underlying experience meet all applicable local, state, provincial, national and other laws, rules and regulations, and that the goods and services described in any experience page posting are actually delivered in a satisfactory manner.
YOU UNDERSTAND AND AGREE THAT PAVILION IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN ORGANIZERS AND VISITORS, NOR IS PAVILION AN AGENT OR INSURER. THE SERVICES ARE INTENDED TO BE USED TO FACILITATE THE CONNECTIONS BETWEEN ORGANIZERS AND VISITORS. PAVILION CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY PROFILES AND THE CONDITION, LEGALITY OR SUITABILITY OF ANY EXPERIENCES. PAVILION HAS NO CONTROL OVER THE CONDUCT OF ORGANIZERS, VISITORS AND OTHER USERS OF THE SERVICES OR ANY EXPERIENCES, AND DISCLAIMS ALL LIABILITY IN THIS REGARD. ACCORDINGLY, THE PLANNING OR PARTAKING OF ANY EXPERIENCES ARE AT THE ORGANIZER’S AND/OR VISITOR’S OWN RISK.
When you use or interact with us through the Services, we may collect Personal Data, as further described below:
Information you provide to us: For all Users we collect Personal Data when you voluntarily provide such information to the Services, such as when you register for access to the Services, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the Services. The Personal Data we may collect includes without limitation your name, email address and other information that enables Users to be personally identified.
When you register for the Services or otherwise submit Personal Data to us, we may associate other Non-Personal Data (including Non-Personal Data we collect from third parties) with your Personal Data. At such instance, we will treat any such combined data as Personal Data until such time as it can no longer be associated with you or used to identify you.
As an Organizer we will collect additional Personal Data from you.
Information you provide to us: In some cases, we may collect your credit card information (e.g., your credit card number and expiration date, billing address, etc.), some of which may constitute Personal Data, to secure certain payments. In addition, if you use our payment processing services, we will collect financial information from you (e.g., your bank account information or an address to send checks) as necessary to facilitate payments and information required for tax purposes (e.g., your taxpayer identification number).
Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as third party websites, your bank, our payment processing partners and credit reporting agencies.
As an Attendee we will collect additional Personal Data from you.
Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as Organizers, other Attendees, social media or other third party integrations, your credit card issuing bank, our payment processing partners or other third parties.
If you provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided.
If you provide Personal Data in order to obtain access to or use of the Services or any functionality thereof, we will use your Personal Data to provide you with access to or use of the Services or functionality and to monitor your use of such Services or functionality.
We may use your Personal Data for internal business purposes, including without limitation, to help us improve the content and functionality of the Services, to better understand our Users, to improve the Services, to protect against, identify or address wrongdoing, to enforce our Terms of Service, to manage your account and provide you with customer service, and to generally manage the Services and our business.
We are not in the business of selling your Personal Data. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third party advertisers.
We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of Pavilion to perform certain business-related functions. These companies include our marketing agencies, database service providers, backup and disaster recovery service providers, email service providers and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.
When you purchase tickets for experience through the experience page we provide the Personal Data (Q-code of ticket, Name) to the Organizers of such experience so they can identify Attendee of experience.
When Attendee buys ticket he gets e-ticket for Experience with information that Organizer provided which will include: Name of Organizer, Address where Experience will be held or meeting point, Contact details such as phone and email.
We may disclose your Personal Data if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.
How We Store Your Personal Data.
You can request access to some of your Personal Data being stored by us. You can also ask us to correct, update or delete any inaccurate Personal Data that we process about them.
We will consider and respond to all requests in accordance with applicable law.
We may retain your Personal Data as long as you are registered to use the Services. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.
You have several choices available when it comes to your Personal Data:
Limit the Personal Data You Provide.
You can browse the Services without providing any Personal Data (other than Automatic Data to the extent it is considered Personal Data under applicable laws) or with limiting the Personal Data you provide. If you choose not to provide any Personal Data or limit the Personal Data you provide, you may not be able to use certain functionality of the Services. For instance, in order to open an account, or buy or sell tickets, your name and email address will be required.
Opt Out from Electronic Communications.
Where it is in accordance with your marketing preferences, Pavilion may send you electronic communications marketing or advertising the Services themselves or events on the Services, to the extent you have registered for the Services or purchased a ticket listed on the Services. You can also “opt out” of receiving these electronic communications by clicking on the “Unsubscribe” link at the bottom of any such electronic communication.
Certain electronic communications from Pavilion are responsive to your requests. For instance, if you are an Attendee, we must email you your ticket when you purchase such ticket. As a further example, if you email our customer support department, we will return your email.
We currently do not participate in any “Do Not Track” frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your Personal Data.

Aggregated Personal Data.
In an ongoing effort to better understand and serve the users of the Services, we often conduct research on our customer demographics, interests and behavior based on Personal Data and other information that we have collected. This research may be compiled and analyzed on an aggregate basis and this aggregate information does not identify you personally and we therefore consider and treat this data as Non-Personal Data.
If you have a complaint about Pavilion’s privacy practices you should email to us at email@example.com. We will take reasonable steps to work with you to attempt to resolve your complaint.
What are cookies?
Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by website owners in order to make their websites work, or to work more efficiently, as well as to provide reporting information.
Cookies set by the website owner (in this case, Pavilion) are called “first party cookies”. Cookies set by parties other than the website owner are called “third party cookies”. Third party cookies enable third party features or functionality to be provided on or through the website (e.g. advertising, interactive content and analytics). The parties that set these third party cookies can recognize your computer both when it visits the website in question and also when it visits certain other websites.
Pavilion uses first and third party cookies for several reasons. Some cookies are required for technical reasons in order for our Sites to operate, and we refer to these as “essential” or “strictly necessary” cookies. Other cookies enable us to track and target the interests of our users to enhance the experience on our Sites. Third parties serve cookies through our Sites for advertising, analytics and other purposes.
Social Networking Cookies
These cookies are used to enable you to share pages and content that you find interesting, or experiences you might attend, on our Sites through third party social networking and other websites. These cookies may be used for advertising purposes too by those social networks.
What about targeted advertising?
We do not offer you 3rd party advertising on our Sites, however organizers selling tickets to events on our Sites may use information about your visits to our Sites and other websites in order to provide relevant advertisements about goods and services in which you may be interested. Organizers may also employ technology that is used to measure the effectiveness of advertisements. This can be accomplished by them using cookies or web beacons to collect information about your visits to our Sites and other sites in order to provide relevant advertisements about goods and services of potential interest to you. The information collected through this process does not enable us or them to identify your name, contact details or other personally identifying details unless you choose to provide these.
